Terms and conditions of open training

§ 1. General provisions
- These Terms and Conditions set out the rules for organising open training courses, registering for them, making payment and cancelling participation, where such courses are organised by the Organiser.
- The organiser of the training is IS Consulting spółka z ograniczoną odpowiedzialnością (a Polish limited liability company) with its registered office in Warsaw, ul. Żelazna 51/53, 00-841 Warszawa, entered in the register of entrepreneurs of the Krajowy Rejestr Sądowy (the Polish National Court Register) under KRS number 0001257716, kept by the Sąd Rejonowy dla m.st. Warszawy w Warszawie, XIII Wydział Gospodarczy Krajowego Rejestru Sądowego (the District Court for the Capital City of Warsaw, 13th Commercial Division of the National Court Register), NIP (tax identification number) 5273229833, REGON (statistical number) 545400230, share capital PLN 10 000.00, e-mail address: contact@isconsulting.pl.
- The Terms and Conditions are made available free of charge at isconsulting.pl in a form that allows them to be downloaded, recorded and printed.
- Registering for a training course constitutes acceptance of the Terms and Conditions in the wording in force on the date of registration.
§ 2. Definitions
Wherever these Terms and Conditions refer to:
- the Organiser, this means IS Consulting sp. z o.o. as identified in § 1(2).
- the Training, this means an open training course delivered remotely, according to the programme and on the date announced on the Organiser’s website.
- the Session, this means a specific date of the Training, identified by a permanent identifier shown in the registration form and in correspondence.
- the Registering Party, this means the entity submitting the registration and obliged to pay the remuneration, being a party to the contract with the Organiser.
- the Participant, this means the natural person indicated in the registration as taking part in the Training.
- the Consumer, this means a natural person entering into a contract with the Organiser that is not directly connected with their business or professional activity.
- an Entrepreneur with consumer rights, this means a natural person entering into a contract directly connected with their business activity where it follows from the content of that contract that it is not of a professional character for that person, within the meaning of Article 7aa of the Polish Act of 30 May 2014 on consumer rights (ustawa o prawach konsumenta).
§ 3. Form and conduct of the training
- The training is delivered remotely, on the Microsoft Teams platform.
- Training sessions are not recorded. The Organiser does not record the course of the Training or the image of Participants.
- Participation in the Training requires the Participant to have a computer with internet access of a bandwidth allowing video and audio transmission, a web browser in its current version or the Microsoft Teams application, and a speaker and microphone set. A camera is not required.
- Ensuring the technical conditions on the Participant’s side is the responsibility of the Participant and of the Registering Party. An inability to participate resulting from causes attributable to the Participant, including restrictions of the internal network of their employer, does not constitute grounds for a refund of the remuneration.
- The link to the Session, the agenda and information on technical requirements are sent to the Participant’s e-mail address no later than 3 days before the Session begins.
- Training materials are made available to Participants in electronic form, no later than on the day of the Training.
§ 4. Registration and conclusion of the contract
- Registration takes place solely through the form available at isconsulting.pl.
- Registration requires the details of the Registering Party, the details of the Participants, the details necessary to issue an invoice and acceptance of the Terms and Conditions.
- The registration constitutes an offer to conclude a contract for participation in the Training. The button completing the registration is labelled in a way that unambiguously indicates that submitting the registration entails an obligation to pay.
- The Organiser confirms receipt of the registration by an electronic message containing the registration number, the identification of the Session, the amount of the remuneration and information on the next steps. The contract is concluded upon delivery of that confirmation.
- The number of places at each Session is limited. Registrations are accepted in the order in which they are received. Where no places are available, the Organiser informs the Registering Party of the possibility of being placed on a waiting list or of the nearest alternative date.
- Registration for a Session closes upon expiry of the deadline indicated for that Session, and no later than 2 business days before it begins.
§ 5. Remuneration and payment
- Training prices are given in Polish zloty as net amounts, to which value added tax at the rate of 23% is added.
- For some Sessions the Organiser applies two prices depending on the date of registration. For such a Session the following are given: the price applicable to registrations submitted up to the indicated date, and the price applicable after that date. Both prices are independent prices. The amount of the remuneration is determined by the date on which the registration is delivered to the Organiser.
- A buyer financing the Training at least 70% from public funds, who considers that an exemption from value added tax applies to the service purchased, is obliged to notify the Organiser of this together with the registration or immediately thereafter, and in any case before the invoice is issued, and to submit an appropriate declaration as to the source of financing. Notification after the invoice has been issued does not oblige the Organiser to correct it.
- After accepting the registration, the Organiser issues a pro forma invoice and delivers it to the Registering Party electronically. Payment is made within 7 days of delivery of the pro forma invoice, and in any case no later than 3 business days before the Session begins. If the registration was submitted later than 10 days before the Session begins, payment is made no later than 3 business days before it begins.
- Payment may be made by bank transfer to the account indicated on the invoice or by the electronic payment made available from the invoice. The electronic payment operator is PayPro S.A. with its registered office in Poznań, operating the Przelewy24 service, a national payment institution supervised by the Komisja Nadzoru Finansowego (the Polish Financial Supervision Authority).
- Any refund of remuneration is made using the same means of payment as used by the Registering Party, unless the Registering Party has expressly agreed to another method of refund that involves no costs for them.
- The Participant’s place is reserved upon acceptance of the registration. Failure to pay within the deadline indicated in paragraph 4 entitles the Organiser to release the place and withdraw from the contract, after first calling upon the Registering Party electronically and setting an additional deadline of no less than 2 business days.
- The final invoice is issued in accordance with the applicable tax law and delivered to the Registering Party electronically, to which the Registering Party consents by submitting the registration.
- The remuneration covers the participation of one Participant in one Session, the training materials and the certificate issued on the terms set out in § 8.
§ 6. Minimum number of participants, conditional sessions and cancellation of the training
- Delivery of a Session depends on the registration of the minimum number of Participants set by the Organiser for the given Training.
- Sessions marked on the website as conditional are delivered only once the minimum number of Participants has been reached. That marking is visible before a registration is submitted.
- The Organiser informs Registering Parties of the confirmation or cancellation of a Session no later than 5 business days before the scheduled date.
- The Organiser is also entitled to cancel a Session where circumstances beyond its control arise that make delivery impossible, in particular illness of the trainer, failure of the training platform or force majeure. In such a case the Organiser informs Registering Parties immediately upon becoming aware of those circumstances.
- Where a Session is cancelled, the Organiser offers the Registering Party a choice between participation on the nearest alternative date of the same Training or a refund of the entire remuneration paid. The refund is made within 14 days of the date on which the Registering Party declares its choice of a refund.
- The Organiser’s liability for damage resulting from the cancellation of a Session is governed by the general rules of the Kodeks cywilny (the Polish Civil Code).
§ 7. Cancellation and change of participant
- The Registering Party is entitled to substitute another person for the registered Participant, free of charge, no later than 2 business days before the Session begins. Such a change is made electronically to contact@isconsulting.pl.
- Cancellation of participation requires documentary form. The date of cancellation is the day on which the declaration is delivered to the Organiser.
- Cancellation of participation is subject to the following rules:
- cancellation delivered more than 14 days before the Session begins: no charge, refund of the entire remuneration paid,
- cancellation delivered in the period from 14 to 7 days before the Session begins: a charge of 50% of the remuneration,
- cancellation delivered less than 7 days before the Session begins, and absence of the Participant: the remuneration is due in full.
- The provisions of paragraph 3 do not limit the rights of a Consumer or of an Entrepreneur with consumer rights arising under § 9.
- Instead of cancelling, the Registering Party may request that the Participant’s participation be transferred to another announced date of the same Training, provided that places are available on that date. A transfer made more than 7 days before the Session begins is free of charge and possible once only.
§ 8. Certificate
- After the Training ends, the Organiser issues the Participant with a certificate of participation in electronic form.
- The certificate is issued on condition that the Participant was present for at least 80% of the duration of the Session. Attendance time is established on the basis of the attendance report generated by the Microsoft Teams platform.
- The certificate is issued within 14 days of the end of the Session, to the Participant’s e-mail address.
- The certificate confirms participation in the Training. It does not constitute certification of competence, is not an official document and does not confirm that any regulatory requirements have been met by the Participant or their employer.
§ 9. Right of withdrawal available to consumers
- A Consumer and an Entrepreneur with consumer rights are entitled to withdraw from a distance contract within 14 days of its conclusion, without giving a reason and without incurring costs, subject to paragraph 3.
- The declaration of withdrawal may be made in any form, in particular using the template set out in Annex 1 to the Terms and Conditions, sent to contact@isconsulting.pl or to the address of the Organiser’s registered office.
- The right of withdrawal does not apply to a contract for the supply of a service for which the Consumer is obliged to pay a price, where the Organiser has fully performed the service with the express and prior consent of the Consumer who, before performance began, was informed that upon performance they would lose the right of withdrawal and acknowledged this, in accordance with Article 38(1)(1) of the ustawa o prawach konsumenta (the Polish Act on consumer rights).
- Where the date of the Session falls before the expiry of the withdrawal period, submitting a registration requires the separate declaration referred to in paragraph 3. That declaration is collected in the registration form as a separate checkbox that is not pre-ticked.
- In the event of withdrawal from the contract, the Organiser refunds the remuneration received without delay, and no later than within 14 days of receiving the declaration of withdrawal.
- Where, at the Consumer’s request, performance of the service began before the expiry of the withdrawal period and the Consumer subsequently withdrew from the contract, the Consumer is obliged to pay for the services performed up to the moment of withdrawal.
§ 10. Copyright
- The training materials and the content of the Training constitute works within the meaning of the Polish Act of 4 February 1994 on copyright and related rights (ustawa o prawie autorskim i prawach pokrewnych) and are protected.
- The Participant is entitled to use the training materials solely for their own use connected with their professional activity, within the Registering Party’s organisation.
- The Participant is prohibited from recording the course of the Training, including recording image or sound, taking screenshots for the purpose of disseminating them, and reproducing or disseminating the training materials beyond the scope indicated in paragraph 2.
- A breach of paragraph 3 entitles the Organiser to exclude the Participant from the Session, without a refund of the remuneration, and does not exclude any further claims available to the Organiser.
§ 11. Complaints
- Complaints concerning the manner in which the Training was delivered, the training materials or the settlements are submitted electronically to contact@isconsulting.pl or in writing to the address of the Organiser’s registered office.
- A complaint should identify the Registering Party, the registration number, a description of the objections and the request made.
- Complaints are submitted within 14 days of the end of the Session and, in the case of complaints concerning settlements, within 14 days of receipt of the invoice. Submitting a complaint after that deadline does not deprive the Registering Party of the rights arising from the law.
- The Organiser examines the complaint and replies within 14 days of receiving it.
§ 12. Protection of personal data
- The controller of the personal data of Participants and of the persons indicated in the registration is the Organiser.
- Detailed information on the processing of personal data, including the purposes, legal bases, recipients of the data, retention periods and the rights available, is contained in the information notice made available with the registration form and in the privacy policy available at isconsulting.pl.
- The recipients of the personal data are in particular: Microsoft Ireland Operations Limited as the provider of the training platform, PayPro S.A. as the electronic payment operator, and IC Partners Stratego S.A. as the Organiser’s accounting office, each within the scope of the data necessary to perform the tasks entrusted to them.
- The data contained in the registration are not stored in the database of the isconsulting.pl website. They are transmitted by e-mail and stored in the Organiser’s Microsoft 365 environment for the period indicated in the information notice.
- The Organiser processes the attendance report generated by the Microsoft Teams platform solely in order to confirm that the condition referred to in § 8(2) has been met.
- Sessions are not recorded, which means that the Organiser does not process the image or voice recording of Participants.
§ 13. Out-of-court dispute resolution
- A Consumer is entitled to use out-of-court means of handling complaints and pursuing claims, in particular to apply to a permanent consumer arbitration court, to the voivodeship inspector of the Inspekcja Handlowa (the Polish Trade Inspection) with a request to open mediation proceedings, and to obtain free assistance from the district or municipal consumer ombudsman.
- The use of out-of-court dispute resolution is voluntary.
§ 14. Final provisions
- Matters not regulated by these Terms and Conditions are governed by Polish law, in particular the Kodeks cywilny (the Polish Civil Code) and, as regards contracts concluded with Consumers and with Entrepreneurs with consumer rights, the ustawa o prawach konsumenta (the Polish Act on consumer rights).
- The Organiser is entitled to amend the Terms and Conditions. An amendment does not affect contracts concluded before the date on which it enters into force. Registrations submitted before an amendment are governed by the Terms and Conditions in the wording in force on the date the registration was submitted.
- The new wording of the Terms and Conditions is published at isconsulting.pl together with an indication of the date on which it enters into force.
- These Terms and Conditions enter into force on 7 September 2026.
Annex 1. Template declaration of withdrawal from the contract
This form is intended for Consumers and for Entrepreneurs with consumer rights. Use of the template is not obligatory.
